You read about the denials. You experience the RFEs (requests for additional evidence). You know there’s much more to do to file an immigration case today and little time to do it. These are real problems.

We want to believe it will not happen to our case; ours will get approved. We’ll be free from the stress, anxiety, and uncertainty and have it all under control.

Focus helps. Routine helps. Guidance helps.

But we can’t expand time. We can’t change the administration’s directives. We need something to change if we’re going to dig out from below.

There is only one way to prepare for these times. We’ll talk about it in this newsletter.

An Arbitrary, Capricious, and Unlawful
H-1B Extension Denial


Despite significant evidence that an Assistant Project Manager was a specialty occupation which required at a minimum a bachelor’s degree and sophisticated knowledge of construction systems, advanced project scheduling, cost estimation and analysis, information systems and supply chain management, USCIS arbitrarily and unlawfully denied an employer’s H-1B extension petition.

The employer is a major commercial construction company attempting to maintain its US-based workforce to continue to deliver projects of vital importance in the transportation, health, and utility fields. It employs over 2,500 people in the United States and has a gross annual revenue of $3.8 billion. It finances, builds, and maintains complex and vital US infrastructure.

Expect More Form I-9 Audits: Are You Ready?


A client who received an ICE visit recently said to me, “Giselle, I don’t want to see ICE here again. How can we best prepare?”

As promised in October of 2017, throughout this year employers have experienced a ramping up of I-9 audits and ICE (Immigration and Customs Enforcement) visits.

Medical Exams Now Valid for Longer


Starting today, medical exam required for adjustment of status applicants will be valid for two years. Previously, exams were only valid for one year.
