You read about the denials. You experience the RFEs (requests for additional evidence). You know there’s much more to do to file an immigration case today and little time to do it. These are real problems.

We want to believe it will not happen to our case; ours will get approved. We’ll be free from the stress, anxiety, and uncertainty and have it all under control.

Focus helps. Routine helps. Guidance helps.

But we can’t expand time. We can’t change the administration’s directives. We need something to change if we’re going to dig out from below.

There is only one way to prepare for these times. We’ll talk about it in this newsletter.

Our clients are overcoming the current immigration challenges. They are ready, willing, and armed with the knowledge and flexibility needed to achieve their goals.

Our team thrives because our clients thrive. We handle very sophisticated immigration projects, tasks, and assignments with success because of our clients’ partnership.

There is too much to do and little time to do it— read below about expected delays, new RFEs, insights about the L-1 visa, success stories, and updates about our team.

When you partner with others, especially those with expertise and passion in the things that need doing, then much more gets done.

As always, thank you for your readership, partnership, and referrals.

An Arbitrary, Capricious, and Unlawful
H-1B Extension Denial

Despite significant evidence that an Assistant Project Manager was a specialty occupation which required at a minimum a bachelor’s degree and sophisticated knowledge of construction systems, advanced project scheduling, cost estimation and analysis, information systems and supply chain management, USCIS arbitrarily and unlawfully denied an employer’s H-1B extension petition.

The employer is a major commercial construction company attempting to maintain its US-based workforce to continue to deliver projects of vital importance in the transportation, health, and utility fields. It employs over 2,500 people in the United States and has a gross annual revenue of $3.8 billion. It finances, builds, and maintains complex and vital US infrastructure.

Expect More Form I-9 Audits: Are You Ready?

A client who received an ICE visit recently said to me, “Giselle, I don’t want to see ICE here again. How can we best prepare?”

As promised in October of 2017, throughout this year employers have experienced a ramping up of I-9 audits and ICE (Immigration and Customs Enforcement) visits.

These audits have been carried out against employers both large and small.

Success Story: "We faced an extremely tight timeline."

“We engaged Giselle Carson and her team to extend our petition connected with our L-1/L-2 visas. We faced an extremely tight timeline, and with their professionalism and dedication, they were able to help us achieve our goal.”

“Giselle was able to provide us with a clear explanation of the process and set reasonable expectations. She is extremely knowledgeable on the current immigration laws and worked tirelessly to achieve a desirable outcome.”

“Not only is this team extremely professional but they are also very personable, which comes through in their work and excellent customer service. We plan on engaging their services again in the future and would highly recommend her to prospective clients.”

Our clients thrive. We thrive. Thank you for partnering with us!

What Is the

L-1 Visa?

Due to the limited number of H-1B visas, the L-1 is currently the preferred visa used by global companies to transfer executives, managers, and employees with specialized knowledge to the U.S.
