Why Lease Agreements Should be in Writing, NOT Verbal:

Lease and Rental Agreements should ALWAYS be in writing, even though most states enforce oral agreements for certain periods of time. While oral agreements may seem easy and friendly, they often lead to major issues. If a tenant and landlord later disagree about certain items, such as whether the tenant can have a pet in the home, the end result is all too likely to end up in court! This is particularly a problem with long-term leases, so courts in most states will not enforce oral agreements that are longer than one year. So why not protect yourself and put it in writing?? Here you can find a sample Lease Agreement.

Some very important key factors for having a lease or rental agreement in writing is to lay out the grounds for important issues such as:

  • Length of the lease/rental period
  • Amount of rent and deposits for the tenant
  • Late fess and due dates
  • Charges if a rent check bounces / terms thereafter
  • Number of people who can live on the rental property
  • Any legal non-returnable fees, such as for cleaning or pets.
  • Who will pay for certain/all utilities
  • Whether the tenant may have pets on the premises
  • Whether the tenant may sublet the property
  • Repairs and Maintenance
  • Landlord entry into the property (Varies by state) Typically 48 hours 
  • When and how you will return the deposit and account for deductions after the tenant moves out 

Also, since you are covering all your bases, make sure to have a Move-In Checklist and walk through with the tenant before they move in so there is no dispute on what is damaged and what is not upon move-out. You can obtain a move-in/out form here.

Remember to check with your state regarding your Landlord/Tenant Laws and know your rights!! They vary by state. This site has great free landlord forms that you can fill in that are state specific.
