Happy New Year to all! IAMA has much to accomplish in 2014 and will continue to provide you with the best training and development opportunities.  The new IAMA Arbitration Rules will be officially launched at the 2014 Annual Conference. Feedback on the draft rules can be sent to us at iama@iama.org.au.

The Professional Certificate in Arbitration will commence in March 2014 and applications are accepted until Monday 3rd February 2014.  The Course is designed to strengthen your understanding of the role of Arbitration and the process and legislative framework of commercial arbitration in Australia.  Online learning is available making the Course available to members from all states. 
We encourage all Associate Members of IAMA to take up accreditation in the ADR profession to advance you to full Member status of the Institute. Feel welcome to speak with your local chapter about what opportunities are available in the coming months.

Registration For The Professional Certificate In Arbitration Ends Next Month

The program is jointly offered with the University of Adelaide and is available to all members.  It is delivered through a combination of face to face workshops and online learning over one year. 

This qualification will be attractive to a diverse range of applicants who are interested in improving their knowledge and understanding of the legal principles, tools and techniques of arbitration.

Court of Appeal Reversed Decision On BCIPA Payment Claims For Work Subject To Mining Leases 


It was previously decided in, Agripower Australia Ltd v J & D Rigging Pty Ltd & Ors, that work carried out on land subject to a mining lease was not "construction work" under the Building and Construction Industry Payments Act 2004 (QLD) (BCIPA).  

Adjudicators should be aware that last month the Queensland Court of Appeal has reversed that previous decision.  The Queensland Court of Appeal has re-opened the door for a subcontractor or a contractor to use the BCIPA to recover payment for works carried out on land subject to mining leases.
