The annual ACBA Bankruptcy Symposium is a half-day program designed for bankruptcy practitioners to keep up to date with the latest developments in the field.

Panel 1: A View From the Bench with Chief Judge Roger Efremsky and Judge Charles Novack

Judges will discuss current trends and the future of bankruptcy practice in the Northern District of California. Topics will include the adoption or opting out of the national chapter 13 plan, confirmation of plans in individual chapter 11 cases, law and motion practice, and the status of the Mortgage Modification Mediation Program.

Panel 2: Pre- and Post-Confirmation Issues in Chapter 13 with Nima Ghazvini and Leo G. Spanos

Staff Attorneys will discuss best practices in confirmation of plans with sale or refinance provisions, the Mortgage Modification Mediation Program, dismissals, and conversions to chapter 7.

Panel 3: Collections: Carnival Rides on the Far Side of the Moon with David J. Cook

David Cook will present an exciting program based on his years of experience representing creditors and judgment collectors. Topics will include:

  • Stay or Go - the judgment in federal court - is state court a better or bad deal?
  • O' Brave New World - new money - new options - new thinking - banking without a branch
  • Getting to Know You - information makes the world go around
  • Random Levies - hit or miss is a hit - but watch for the litigation privilege
  • Centralized Levy Dept. - one stop shopping

ABOUT THE SPEAKERS:


Judge Efremsky headshotChief Judge Roger Efremsky, United States Bankruptcy Court, Northern District of California
Judge Efremsky was appointed to the United States Bankruptcy Court for the Northern District of California in 2006. Prior to that he was the founder and partner of Efremsky & Nagel specializing in representation of secured creditors in federal bankruptcy and state court proceedings with an emphasis on the representation of secured creditors in consumer and commercial matters.

Judge Novack headshotJudge Charles Novack, United States Bankruptcy Court, Northern District of California
Judge Novack was appointed to the United States Bankruptcy Court for the Northern District of California in May 2010. Prior to his appointment, Judge Novack was a sole practitioner in Oakland, representing Chapter 7 trustees, debtors, creditors and other interested parties in Chapter 7, 11 and 13 cases. From 1994 until 2005 he was an associate and then a partner at the Oakland bankruptcy boutique firm of Kornfield, Paul & Nyberg. Judge Novack also served as an associate professor at California State University, East Bay.

Nima is a Staff Attorney at the Office of Martha G. Bronitsky, Standing Chapter 13 Trustee, Northern District of California, Oakland Division. He graduated from UC Berkeley with a BA in Political Science and received his J.D. at Southwestern University School of Law. He is admitted to practice in the State of California and the United States District Court, Northern and Central Districts of California. Nima is the Chair of the ACBA Bankruptcy Section's Executive Committee.

Leo is a Staff Attorney at the Office of Martha G. Bronitsky, Standing Chapter 13 Trustee, Northern District of California, Oakland Division. He graduated from UC Santa Barbara with a BA in Political Science and received his J.D. at UC Hastings College of Law. Leo is admitted to practice in the State of California and the United States District Court, Northern District of California.

David Cook headshotDavid J. Cook, Cook Collection Attorneys
David has been practicing in the area of enforcement of judgments and collection of debts for the past 40 plus years. He represents Fred Goldman in his seminal quest to recover the wrongful death judgment against O.J. Simpson. David J. Cook is the author of the Debt Collector's Handbook (ABA, 2015) and Collection, Demand and Commercial Letters (ABA, 2015), along with over 100 articles.
