Important updates from USA Today's Berkowitz on the excise tax guidance from the Treasury Department & IRS. What's the deal? 1) "Private schools and public schools carrying one type of federal tax-exempt status clearly will have to pay."; 2) "Other public schools — including Texas, Texas A&M, Clemson, Oregon, Minnesota and Houston — can claim they will not have to pay because they assert that they are government units that have federal tax immunity without holding any other tax-exempt status." No clear indication if the position will hold.; and, 3) "Public schools that have another type of federal tax-exempt status are currently subject to the excise tax, but the new guidance also says these schools may voluntarily relinquish that status, although doing so might still leave them subject to the excise tax." Alabama, Michigan & UCLA are a selection of institutions who fall in the final group. Subject matter expert & Spencer Fane executive compensation attorney Denny calls the situation a "major competitive imbalance," notes the trickle down effect of what a million or two can mean to a department. The Athletic's Feldman gets a first-hand tour of the new Transfer Portal, says the biggest challenge is "sifting through" all the entries to understand who's who. Feldman's unidentified guide, "Lots of these guys are walk-ons who never played. You have FCS guys mixed in. You don’t know if he’s an All-American or he’s graduated and just put his name on here. There’s no filter. You don’t know even know if they’re academically eligible. It’s interesting." Feldman proceeds to identify some student-athletes in the portal who have notable competitive statistics, many more who are unknowns, indicates it's usually a recruiting staffers job to keep up with any non-obvious new entries. Key note for student-athletes, "It’s a case where, if you’re gonna put your name out there, understand the coaches don’t have to renew you." (link)

It’s come together pretty quick. [...] ...this now brings instant credibility and instant awareness of who we are playing from our fans. They bought it." That's Dixie State (DII) AD Boothe on the Trailblazers move to DI & the WAC. Simultaneously, DSU announced a three-year FB series with nearby Southern Utah, plus a $1M gift for an upgraded Softball complex. WAC Commish Hurd: "Many of the facilities here are already Division I facilities, there is great community support, and there is great leadership and commitment at the top. I can’t emphasize enough how much of a role that plays. You have to have leadership and commitment, and that is what is here." (link)
Washington State Prez Schulz indicates the Cougars are getting closer on a naming rights deal for the field in Martin Stadium & the Cougar FB Complex, points to optimism for such news to be official during the spring semester. Darigold, the marketing and processing arm of the farmer-owned Northwest Dairy Association, is believed to be the brand at the center of the discussions. Schulz: "The good news is our football product is seen as really nationally relevant, exciting, and there is lots of interest seen in what we’re doing along the West Coast. So we’re in a really good point in time to be talking about some of these things with potential partners." (link)
The Presidential & AD leadership changes at Eastern Michigan back in 2017 resulted in The Power2Change Foundation's $6M cash pledge for the Eagles to be put on hold. Current EMU boss Wetherbee says he's "still having conversations with that group...I'm still hopeful we'll get all of that." As you may recall, the $6M was to go toward a new sports med & performance training center, with a first phase price of $20M. EMU has raised $5M thus far for the project. Wetherbee notes he's super focused on continuing to build more relationships, "I'm not blinded by the fact that Heather (Lyke) was very up front with me when I took the job that it’s a struggle to go and get those fundraising dollars and there’s only so many pots to go and get them from." (link)
Texas becomes the second state - after New York - to cancel all MBB recruiting events in the month of June. Texas Association of Basketball Coaches Executive Director Sherley: "Yes, with the restrictions they put on us we’re pretty much in the same boat as New York." Private schools in the state are still fair game & Sherley estimates 20% of DI signees come from the private ranks. (link); Notable recruiting voice Daniels: "Players in New York & Texas that aren't USAB or NBPA Top 100 level prospects will only get to play in front of coaches 10 days this spring & summer (3 in a regional camp setting). Last year they had an opportunity to be seen 21 days in the the spring & summer." (link)

Reported College Football Playoff payouts to 'Group of 5' leagues that cumulatively equals $86M from the recently completed season: Mountain West = $20.4M, American = $18.8M, Sun Belt = $17.2M, Conference USA = $15.6M & MAC = $14M. $70M is divvied equally with the other $16M dispersed based on performance rankings from the six computer polls that previously crunched the BCS numbers. With the Sun Belt finishing third, outgoing Commish Benson, "I think it clearly demonstrates that Sun Belt football is trending upwards and has established itself as a very credible and viable conference in major college football." (link)
Clemson FB is headed to the White House on Monday. President Trump says he's excited to host the Tigers, "What a game, what a coach, what a team!" Stadium's Goodman continues his "Chain of Command" series with the MAC as league coaches vote on the best HC jobs based on nine variables. Final rankings: Ohio, Toledo, Akron, Kent State, Ball State, Buffalo, Western Michigan, Bowling Green, Miami (OH), Central Michigan, Eastern Michigan, and Northern Illinois. Interestingly, Ohio finished at the top overall, as well as in budget/resources, buy games & "selling pros," but 10th in recruiting base. (link)

FB Scheduling: Iowa has added Utah State & Western Michigan to its 2023 docket. (link, link); Michigan will host Western Michigan & Northern Illinois in 2021, looks like the Wake Forest kick scheduled for the same season has been postponed. Also for the Wolverines, Colorado State in 2022 & Bowling Green in 2023. The Rams will get $1.8M. (link, linklink); Idaho & Eastern Washington will play a non-conference tile in Moscow next season. North Carolina's Rams Club asked the state for $98M worth of bonds for renovations to the Smith Center, Kenan Stadium & other fresh digs. However, state treasurer Folwell countered to the group, "The board doesn’t need to be suffocated with people who are connected to the Rams Club. I can tell you that that heat will not be well received. The board just needs to do their own work, and come to their own conclusions. We understand what your needs are, and why you’re here." Sounds like Folwell's board may not vote until next month. Also of note on the Rams Club, "It has a cash balance of $35.6 million, and total net assets of $285 million. This is the first time it has sought tax-exempt public bond financing from the state." BB&T handles the bonds. (link)
Another lawsuit for Oregon aimed at the university, former FB HC Taggart & former Strength boss Oderinde. This time the damages ask is $5M & it's from current student-athlete Poutasi. University statement: "The well-being and safety of our students are our top priorities at the University of Oregon. We have been advised of the litigation filed today but have not been served a copy of the complaint, at which point we will respond appropriately in the court proceedings. In light of the pending litigation, we don’t have any additional comment at this time." (link)
NM Fishbowl's Libit says he has filed a third public records lawsuit against the University of New Mexico, this time against the Lobo Club, specifically. "The Foundation is also named as a co-defendant in my Lobo Club suit, as are UNM’s Board of Regents, Lobo Club interim Executive Director Jalen Dominguez, Foundation paralegal Jen Jelson and UNM interim Public Records Custodian Christine Landavazo, all in their official capacities. The caption of the case indicates how intractably interwoven the university’s fundraising operation is, which happens to be at the heart of the lawsuit." More. (link)
