The Alston case gets moving in earnest today in Oakland. Plaintiff's attorney Berman: "The court has already ruled in our favor that the caps on compensation are anti-competitive and are a restrain on trade. Normally, firms with market power can’t agree to set prices. In this case the price being payments to athletes. Now it’s the NCAA’s burden at this trial to show that the restraint is justified by some pro-competitive justification." NCAA General Counsel Remy: "As was demonstrated in the O’Bannon case, the NCAA will show that our rules are essential to providing educational opportunities to hundreds of thousands of student-athletes across the country." The trial will last for two-ish weeks with a ruling possible in December or January. (link); Notable attorney Johnson, who was plaintiff's counsel in Oliver v. NCAA, dives deeper into the Alston case, "Absent an epiphany being visited on the plaintiffs’ counsel, my guess is that Judge Wilken will find in favor of the plaintiffs and craft a narrow remedy, the Ninth Circuit will cut that remedy back, and things will continue as they have been … Until the NBPA gets fed up and organizes P5 men’s basketball." Fresh off a pro wrestling-after-FB debut, North Texas AD Baker raps with former Tennessee AD Hamilton on his 'From the Chair' podcast. The pair dig into Baker's leadership background in the broader education space, as well as UNT's notable momentum. Baker: "You never know when you are making connections that can possibly help you in the future. Prior to kickoff of Saturday night's game in Orlando against Louisville, Alabama AD Byrne noted the importance of the state of Florida for the Crimson Tide. Ultimately, Byrne sees a hybrid model of scheduling for FB in the future, featuring big name out-of-conference opponents in both Tuscaloosa & also at neutral site venues. Byrne: "One of the things you have to find is dates that work and years that work and that’s easier said than done at times." (link)

Of course, Kaepernick is also at the center of may political machinations due to his high-profile kneeling during the National Anthem & his on-going grievance process with the league. Overall, it's a situation many of your student-athletes, fans & donors are likely watching. Iowa State AD Pollard calls finding & scheduling a 12th FB game "a really dicey situation." Pollard has identified two FCS possibilities, "One of them has said they absolutely will not play us. The other has said they would consider playing us but the only way they could play is if we played on the Championship Weekend. However, if they’re in their championship game, they can’t play." Alternately, there are nine FCS programs with the same bye week as the Cyclones (Oct. 20), but an NCAA waiver would have to be granted to play the 12th game. More excerpts from the coming book featuring former Louisville MBB HC Pitino includes claims that Kentucky Governor Bevin told confidants he was trying to push former U of L AD Jurich out in a political move that would play well to his base across the state. Pitino: "Instead, I believe Tom's successful deal-making ruffled too many feathers. […] The genesis of Tom's demise lies, I believe, somewhere in the events surrounding the KFC Yum Center. […] Tom and the U of L were guilty of being good negotiators. He wrangled favorable revenue share agreements prior to arena construction. Was that Tom's fault? I need to learn a better way to respond to that and I pray every Sunday that I never get angry. But it was a time and circumstance thing for me. Pretty interesting read from AT&T may reimagine the TV landscape with so may assets now living under one roof. Here's a helluva starter, "AT&T wants audience size to determine how much cable TV-like streaming services such as DirecTV Now pay to carry TV channels, rather than how many people subscribe to the services, according to a top AT&T executive." Naturally, many network executives are expected to push back strongly on such a change. "When well-intended managers are too inclusive with their meeting invites: 1) There is not enough time for everyone to participate in the conversation; 2) Rich back and forth debate is replaced by shallow comments; 3) Information-sharing and catch-ups distract from addressing higher priority issues; 4) People become more guarded and less candid; and 5) Tough topics and decisions are not put on the agenda, then are dealt with off-line instead." How do you change this? 1) Tell your team that you're making a change, be transparent; 2) Be thoughtful with your invite list; 3) Be clear with your team about their responsibilities - both those who are in attendance and those who are not; and 4) Measure your success. Delaware opened its new student-only tailgating area, 'The Barn', ahead of FB's home opener against Rhode Island. Capacity is 2K & there's a bar area for those over the age of 21. Assoc. AD for Marketing & Engagement Sirdofsky says the effort is a sign athletics wants to collaborate with the student body. More Sirdofsky, "I’ve had a lot of students come up to me and say that 'we want to come to games, but we don’t feel like there is anywhere for students to go,' and the whole point of this space is that it’s completely student-centric, there’s no alums, no season ticket holders. College is about coming and meeting new people and building that sense of school spirit and establishing yourself here in the UD community, and this is one way to do that." (link)

INFLCR CEO Cavale: "Fresno State has always been a diamond in the rough for what is now known as the Group of Five conferences. A new working paper published by the National Bureau of Economic Research finds that employing a Chief Diversity Officer does not correlate with significant gains in faculty diversity. "Using a wide variety of robust specifications [hiring of chief diversity officers with federal faculty and administrator hiring data by race and ethnicity from 2001-2016 at research and master’s degree-granting institutions with 4,000 students or more], we are unable to find significant evidence that the presence of an executive-level CDO alters preexisting trends of increasing faculty and administrator diversity in the institutions we study. Although important progress has been made in increasing faculty and administrator diversity from 2001 to 2016, we believe more work must be done to better understand barriers to increased diversity, and how they might be best addressed."
