Swiss Banks: Special Disclosure Program
Over the last few years, the Tax Division of the U.S. Department of Justice (DOJ) has been battling the problem of tax evasion by international bank account holders. Armed with the threat of criminal prosecution, the DOJ has initiated several programs to encourage disclosure of account activity/tax information of U.S. accounts around the world.
With Switzerland being an obvious starting point in the offshore tax war, the DOJ launched a full investigation into its tax activity and offshore banking practices of U.S. account holders, resulting in the criminal prosecution of a number of Swiss bankers, lawyers, investment advisors and account holders. Fourteen banks are currently under grand jury investigation, including Credit Suisse, Julius Baer, Zurich Cantonal Bank and Pictet.
In August of 2013, the DOJ entered into an agreement with the Swiss government, offering them the program for Non-Prosecution Agreements or Non-Target Letters for Swiss Banks (PFSB). The program will protect participating Swiss financial institutions from criminal prosecution for breaking U.S. tax laws. The program would allow Switzerland to once again become an attractive option for international monies.
